Session Fee: 

Client agrees to pay photographer a non-refundable session fee of 50% at time of booking (Investment amount varies based on type of session)  remainder due before the session starts. This fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a digital gallery of images (digital downloadable link, amount of images determined by type of session you choose.

 

Location Costs & Fees: 

If there are any costs/fees associated with the location the client has chosen for their session, you the client, will be responsible for those fees. The photographer will not guarantee or arrange any payment on any location. Creative fee covers travel to any local locations. Any location outside of city limits will be subject to an additional charge of $0.55/km as part of the agreement.

 

Circumstances: 

If an illness or situation prevents a photo session from taking place, client may reschedule at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

Proofs: 

Proofing of client’s images will be available for viewing within 3 weeks of session date in a password-protected web-gallery.

Ordering:

Due to the custom nature of each session, all sales are final and non-refundable. Client must be absolutely sure of their purchase prior to the end of your ordering session, as print orders are placed to our professional lab within one to two (1-2) business day(s) after your order is placed.

Archive:

All images will be available for ordering for a period of 3 months following client delivery date. After a period of 12 months, all images will be deleted from photographer’s hard-drive, except those agreed upon and released for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for lost or damaged digital files, due to circumstances being beyond photographer’s control.

Payment:

 All payments are due in full at time of session, unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.

 

Damage: 

Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by Canada Post or any other mail carrier. Client assumes all responsibility for the safety of all portraits upon receipt. All portraits sent via Canada Post can be insured and require delivery confirmation upon client’s request and at client’s expense.

 

Model Release: 

Photographer kindly asks that all clients sign the model release so that photographer may display the images from their session on photographer’s website, www.love4calisphotography.com, company, Facebook page, Instagram or any other social media platforms chosen, and for using for marketing/promotional/ advertising purposes.

 

Liability:

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. 

Illness: clients to their knowledge are healthy and will cancel their session if they or someone is displaying illness.  booking sessions with Love4calisphotography is voluntary and clients understand that we due diligence in sanitation and percausions to keep clients safe. Love 4 Calis photography can not be held accountable if illness is spread.

 

Copyright & Penalty:

Love 4 Cali's photography retains all copyrights to all images created during client’s session. A print release may be purchased with digital files to print portraits for personal use up to designated size listed on print release. It is illegal to copy, scan, download, print, share, or alter any image created by Love 4 Cali's photography during client’s photo session.

 

Indemnification: 

The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.

 

Waivers: 

The waiver of any breach of this Contract shall not constitute a continuing waiver or a waiver of any subsequent breach of the same or a different provision of this Contract.

 

Attorney’s Fees: 

If either party to this Contract brings a legal action against the other party to this Contract to secure the specific performance of this Contract, collect damages for breach of this Contract, or otherwise enforce or interpret this Contract, each party shall be responsible for their own reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded.

 

All & any sessions:

Scheduled with Love 4 Cali's photography must have a signed agreement and full session payment before any portraits will be taken.

Cancellations:

There shall be no refund of the retainer.  Any and all payments toward the balance are non-refundable once paid.  Any and all cancellations must be in writing by email.
